TERMS OF SALE
These Terms of Sale (hereinafter referred to as the “Terms”) set forth the conditions for selling products offered by 3DFORM Sp. z.o.o. (hereinafter the “Seller”), as well as rules for their use. The Seller reserves the right to introduce changes to these Terms or the Privacy Policy, for instance in response to new legal, regulatory, or functional requirements. Users will be informed of any such changes by means of a notice on the website, visible for at least ten (10) days from the date of publication.
The service and online store operate on an e-commerce platform, enabling the Seller to sell its products. Online sales are governed by relevant consumer law and regulations, including those concerning electronic commerce. Below are the Terms of Sale applicable to all products available in our online store.
1. DEFINITIONS
For the purposes of these Terms, the following definitions apply:

- Terms / Agreement: this document, which defines the relationship between the Seller and the Client and the rules for selling products.
- Platform / Website: the online service operated by the Seller, for instance www.canvasshapes.com (adjust to the actual URL).
- Users: individuals who visit the Website and review its offerings.
- Client: any User who decides to purchase products offered on the Website.
- Consumer: a natural person making a purchase for purposes unrelated to their business or professional activities.
- Entrepreneur (Professional): a natural or legal person acting as part of a business or professional activity, providing a NIP/VAT number (if applicable).
- Products: the assortment available through e-commerce, including canvas prints, interior décor items, and other similar products.
- Purchase Order / Order: a proposal to purchase submitted by the User via the online store system (e.g., the “Cart”).
- Cart: a stage in the purchasing procedure in which the User compiles products and chooses the delivery and payment methods.
2. SUBJECT OF THE TERMS
These Terms of Sale apply to the products specified in Section 3 and govern all contractual relationships between the Seller and Users of the Website—whether they act as Consumers or as Entrepreneurs.
If one or more provisions of these Terms become invalid or unenforceable, it does not affect the validity of the remaining provisions. In such a case, the parties will strive to replace the invalid clause with one that effectively reflects the original intent.
3. PRODUCT DESCRIPTION
The Seller conducts retail sales of products (e.g., canvas prints with various customization options, interior décor items). Each product is described in its respective section of the Website, detailing the product’s features and specifications.
Product images on the Website are for illustrative purposes only; minor discrepancies may exist between the graphical representation and the actual item. In the case of personalized products (e.g., selecting frame colors), once customization is chosen, the order can no longer be modified and the right of withdrawal generally does not apply (due to the individualized nature of the order).
Any discrepancies in appearance that do not substantially affect the functionality or characteristics of the goods shall not constitute grounds for a complaint.
4. PRICES AND DELIVERY COSTS
Product prices are given in the currency applicable to the market (e.g., EUR or PLN) and include basic fees. In the “Cart,” the Client will see the product price and any potential delivery costs.
The Seller strives to ensure that the prices presented are correct; however, in the event of an error (e.g., a grossly low or high price), the Seller reserves the right to contact the Client to offer the correct price or to cancel the order.
The Seller may introduce promotional offers and discounts, as indicated in separate notices on the Website. In the event of technical errors (e.g., an incorrect price), the order may be canceled, and any amounts paid will be refunded within 14 days.
5. ACCOUNT REGISTRATION
Making purchases through the Website may require registration. The Client is responsible for the accuracy and currency of the information provided during registration, and the Seller reserves the right to refuse or cancel an account if abuses are detected.
By registering, the User declares that they are an adult with full legal capacity. The email address provided during registration is used for communication about orders, notifications, and promotions (if the User consents).
6. PURCHASE PROCEDURE
The Client selects products from the offer, adds them to the “Cart,” and follows the instructions on the Website (choosing delivery, payment methods, etc.). After verifying the order details and accepting the Terms, the Client submits the order for processing.
The agreement between the Seller and the Client is formed when the Seller confirms the order (usually via email). The Seller reserves the right to refuse incomplete or erroneous orders, or those for unavailable products—in such cases, any payment already made by the Client will be refunded promptly.
Orders may be canceled within a maximum of 24 hours, provided that the product has not yet entered the production phase.
7. PAYMENT METHODS
The Seller accepts various payment methods, including:
- Stripe – charges the Client’s account at the time the order is placed.
- Cash on Delivery (COD) – not available.
- Klarna – offers installment payments, depending on availability in the given region.
8. SHIPPING AND DELIVERY TIME
Orders are processed on business days (Monday–Friday). The standard shipping time is approximately 6–10 days, although it may be extended depending on production schedules and the destination country, not exceeding 30 days (except in force majeure circumstances). Any delays will be communicated promptly to the Client.
The Seller issues a receipt (or an invoice, if requested) for each purchase, based on the data provided when placing the order. Once the receipt is issued, changing the data is not possible.
A tracking number will be sent to the Client via email. The Client must check the condition of the package upon delivery and, in case of any damage, sign the delivery note with “reservation” and notify the Seller, attaching photographic evidence.
Any additional customs duties or import taxes for shipments outside the EU are the Client’s responsibility. The Seller is not liable for delays due to customs procedures.
9. OPTIONAL SHIPPING INSURANCE
The Seller may offer additional shipping insurance to cover potential damage or theft during transport. Clients are required to contact the Seller if interested in this option.
10. RIGHT OF WITHDRAWAL
A Client who is a Consumer has the right to withdraw from the contract within 14 days of delivery, without giving any reason (provided the product is not personalized or used beyond normal inspection). To exercise the right of withdrawal, the Client must submit a relevant statement (via email or chat) and return the goods to the Seller at the Client’s expense.
The returned item must be in its original packaging, complete, and adequately secured. Once received and inspected, the Seller will refund the amount within 14 days using the same payment method initially chosen by the Client. Delivery costs and any additional charges are non-refundable.
The right of withdrawal does not apply, among other things, to personalized items, items made to order, or (according to the offer) sale items.
11. WARRANTY AND COMPLAINTS
Consumers are entitled to a 24-month statutory warranty in accordance with applicable laws (including the Civil Code and consumer rights legislation). In the event of receiving a defective or incorrect product, the Client should promptly contact the Seller by email, attaching photos and a description of the issue.
Any defect must be reported no later than 48 hours after delivery (if the product arrived damaged). The Client should keep the original packaging and protective materials, and if the product is received with visible damage, that fact must be noted with the courier.
If the Client is an Entrepreneur, the complaint procedures set forth by the Civil Code apply. In a dropshipping model, the Seller remains responsible to the Client for product defects, though in certain cases, direct contact with the manufacturer may be more efficient.
12. FORCE MAJEURE
The Seller shall not be liable for any damage caused by force majeure that prevents the Seller from fulfilling contractual obligations, in whole or in part, within the agreed timeframe (e.g., natural disasters, strikes, failures caused by external providers). In such circumstances, order fulfillment may be suspended for up to three months, after which the parties may decide whether to proceed or cancel the order.
13. INTELLECTUAL PROPERTY
All elements of the service (trademarks, logos, website layout, graphics, texts) are the property of the Seller or used under appropriate licenses. Copying, distributing, or using them for commercial purposes without written consent from the Seller is prohibited.
14. NON-WAIVER OF RIGHTS
If the Seller does not act immediately regarding behavior that violates these Terms, it does not constitute a waiver of the right to pursue claims in the future. The invalidity or unenforceability of any specific provision does not affect the validity of the remaining provisions.
15. PERSONAL DATA PROTECTION (PRIVACY)
Clients’ and Users’ personal data are processed in accordance with the privacy policy available on the Website. The Seller takes appropriate measures to prevent unauthorized data access and does not disclose data to third parties, except in cases provided by law.
Providing data is voluntary, but may be necessary to conclude and perform the contract.
16. GOVERNING LAW AND JURISDICTION
These Terms are governed by Polish law. Any disputes concerning the validity, interpretation, or execution of online contracts will be resolved by the competent Polish courts in accordance with generally applicable regulations.
Clients who are Consumers: in disputes involving Consumers, jurisdiction is determined by the Consumer’s place of residence (the so-called consumer court jurisdiction).
Clients who are Entrepreneurs: in disputes involving Entrepreneurs, the court with jurisdiction over the Seller’s registered office shall have competence, unless mandatory legal provisions stipulate otherwise.
17. ALTERNATIVE DISPUTE RESOLUTION / ODR
A Consumer has the right to use out-of-court dispute resolution methods (ADR). In accordance with Regulation (EU) No 524/2013, a complaint may also be submitted via the Online Dispute Resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr/.
